Nessie Bike Tours - Refunds, Cancellations and Terms & Conditions
By booking or taking part on a bike tour with Nessie Bike Tours, all customers and participants agree to the following:
- Customers agree that they are able to ride a bike including control of speed, direction and operation of brakes and other bike controls. Instruction on use of the equipment provided will be given at the start of the tour. Customers agree that they will follow all rules, laws and road traffic regulations required to participate on a bike tour. Customers also agree to follow the direction and advice of Nessie Bike Tours guides at all time.
- Customers agree to disclose any health condition that may affect their ability to take part in a tour. This information will be treated as confidential and the guide may request additional information from the customer to enable them to provide the most appropriate experience. If a guide judges a customer to be unable to take part in a tour for health reasons, a refund will be offered or an opportunity to take part in another tour.
- If any member of staff or associate of Nessie Bike Tours judges a customer unable to take part in a tour due to lack of competence, behaviour, intoxication or any other reason, the customer will be asked to leave the tour and a refund offered.
- NESSIE BIKE TOURS does not provide insurance for any client or third party. It is the customer’s responsibility to arrange appropriate insurance to cover any activity undertaken during a NESSIE BIKE TOURS tour. On matters of safety during a tour, the decision of a NESSIE BIKE TOURS guide is final. Consumption of alcohol is not permitted as part of a tour.
- Nessie Bike Tours waives all claims for damages made against them. Nessie Bike Tours does not accept or take any liability for any imaginable damage to the participant of tours or to third parties, any other financial loss or property damage and equipment caused during tours or rentals. Customers are responsible for their actions when taking part in a tour.
- NESSIE BIKE TOURS excludes all liability, to the extent permitted by law, for any injury or loss suffered during a NESSIE BIKE TOURS tour. Nessie Bike Tours does not assume any responsibility for the loss of money, valuables, baggage or other items during a tour.
- Customers are responsible for any damage to equipment/bikes provided to them by Nessie Bike Tours with the exception of punctures or mechanical malfunctions which are not caused by the customer. Nessie Bike Tours will inquire and assess all damages made and thereupon determine the extent of liability and cost to customers.
- Customers will be required and agree to wearing a helmet as provided by Nessie Bike Tours. Other optional safety equipment may also be provided.
- All customers are liable for damages or losses that happen due to failure to comply with the above mentioned obligations.
- Any complaint should be made known verbally to NESSIE BIKE TOURS immediately, and in writing within ten days of any incident. NESSIE BIKE TOURS will endeavour to resolve such complaints to the satisfaction of any aggrieved party.
- If a customer does not meet the requirements set out in these terms and conditions or if it is reasonably suspected that a customer cannot safely participate in a tour, Nessie Bike Tours reserve the right to cancel a customer’s place on a tour and there will be no entitlement to a refund.
- These terms and conditions and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the law of Scotland. Each party irrevocably agrees that the courts of Scotland shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these terms and conditions or its subject matter or formation.
Cancellations and Refunds
- Nessie Bike Tours reserves the right to cancel a tour for reasons such as weather, lack of resources, local events, closure of infrastructure or due to low numbers on any given tour.
- No booking will be deemed to have been made until NESSIE BIKE TOURS has received payment in full. Payment in full is due at the time of booking.
- Where a tour is cancelled by Nessie Bike Tours, a full refund will be offered or the opportunity to book on another tour of the same cost or value. Where a customer prefers a refund, this will be offered.
- Where a customer or group arrives late for a tour, or does not arrive at all, they will forfeit any right to a refund. In this case they may still be eligible for another scheduled tour, at the sole discretion of NESSIE BIKE TOURS.
- Prices are correct at time of publishing, but are subject to change.
- Where a customer requests to cancel a tour, the following policy for refunds will operate:
- No Refund will be given if a cancellation is made within 24 hours of the tour. The customer may request a place on an alternative tour if available.
- The customer will be eligible for a 50% refund if a cancellation occurs between 24 hours and 14 days before the tour.
- Customers will receive a 100% refund for cancellations until 14 days before the tour.
- All refunds will be minus any transactions fees occurred through credit card booking and payment processing systems.
